從2010年4月19日開始，甚至追溯到本年度3月27日，澳洲移民部針對571-574這幾種學生簽證的部分要求改革。針對新舊移民法相關572的舉例說明，新的移民法已經提出了高風險國家。而中國，這個高風險國家行列的主要學生簽證申請人候群之一，將受到巨大的沖擊。

從4月19日開始，新的法律及時生效。如果你的申請在3月27之后遞交的申請，并在4月19之前沒有做出結果，將按照新的法律規定。

而移民局網站的補充說明，移民官必須認為你有能力來澳洲讀書，并且遵守簽證條例，還有，你如果你寫過讀書后返回自己的祖籍國的相關承諾等等。

延伸地覺得:如果移民官覺得你不是真正想讀書的，是想移民澳洲的，他們有權利和法律依據拒絕你的學生簽證。雖然變化的條款不多，只是多了一個字highest，但是，這非常明顯地就是針對中國和印度兩個國家。

今后的中國留學生，尤其是來自高風險地區的中國人，將很難獲得學生簽證，拒簽率將攀高！

以下，是舉例說明:拿572舉例，這是新的相關572條例的改變點。

572.223

(1) The Minister is satisfied that the applicant is a genuine applicant for entry and stay as a student because the applicant meets the requirements of subclause (2).

(2) An applicant meets the requirements of this subclause if: (a) for an applicant who is not a person designated under regulation 2.07AO, the applicant gives the Minister evidence in accordance with the requirements mentioned in Schedule 5A for the highest assessment level for the applicant; or (b) for an applicant who is a person designated under regulation 2.07AO -- the Minister is satisfied that: (i) the applicant has the financial capacity to undertake the course, without contravening any condition of the visa relating to work, because the applicant has access to sufficient funds of the person's own or provided by a relative; and (ii) the applicant's proficiency in English is appropriate to the proposed course of study; and (iii) the applicant is a genuine applicant for entry and stay as a student, having regard to: (A) the stated intention of the applicant to comply with any conditions subject to which the visa is granted; and (B) any other relevant matter.
